মূলত হিল্লা বিয়ে বলতে বোঝায় কোনো স্বামী স্ত্রীকে তালাক দেওয়ার পর আবার যদি ওই স্ত্রীকে নিয়ে সংসার করতে চান, তবে কুসংস্কার মতে, তালাকে দেওয়া স্ত্রীকে আগে অন্য পুরুষের সঙ্গে বিয়ে দিতে হবে। পরে আগের স্বামী যদি রাজি থাকেন, তবেই পুনরায় ওই স্ত্রীকে গ্রহণ করতে পারবেন।

বিশিষ্ট আলেম ড. মোহাম্মদ সাইফুল্লাহ বলেন, হিল্লা বিয়ে নামে আমাদের সমাজে যে প্রচলন রয়েছে, এটা ইসলামে সম্পূর্ণ হারাম। এটি একটি সামাজিক অনাচার। এটাকে বিয়ে বলা হয়ে থাকে, কিন্তু এটি একটি হারাম কাজ। যিনি এই বিয়ে করবেন, তিনি হারাম কাজ করবেন। এমনকি এই বিয়ের সঙ্গে যাঁরা যুক্ত থাকবেন, তারা অভিশপ্ত হবেন। আর, যার উদ্দেশ্যে এই বিয়ে করা হবে, তিনিও অভিশপ্ত হবে। এটি একটি অনাচার।

সুতরাং এ ধরনের হিল্লা বিয়ের সঙ্গে যারা জড়িত, তারা সবাই গুনাহগার হবেন। ইসলামের ভাষায় তারা অভিশপ্ত। এটা যদি কোনো সমাজে প্রচলিত থাকে, তাহলে সে সমাজ অনাচারে লিপ্ত।

হিল্লা বিয়ে সম্পর্কে মুসলিম ও পারিবারিক আইনে যা বলা আছে-

তালাক কার্যকরের আগে

আদর্শ জীবনসঙ্গী খুঁজতে

কোনো স্বামী যদি ভুল করে তার স্ত্রীকে তালাক দিয়ে থাকেন। তবে তালাক কার্যকারের আগেই যদি স্ত্রীকে গ্রহণ করতে চান, তবে ক্ষমা চেয়ে চেয়ারম্যানের কাছে একটি আবেদনপত্রই যথেষ্ট। তালাক উচ্চারণের পর তিন মাস ১০ দিনের মধ্যে তালাক কার্যকর হয়।

তালাক কার্যকর

যদি তালাক কার্যকরের পর স্বামী যদি পুনরায় ওই স্ত্রীকে বিয়ে করতে চান, তবে আবার নতুন করে বিয়ে রেজিস্ট্রারি করতে হবে।

হিল্লা বিয়ে বৈধ নয়

মুসলিম পারিবারিক আইনে হিল্লা বিয়ে বলতে কিছু নেই। হিল্লা বিয়ে আইনে বৈধ নয়।

বিয়েতে স্ত্রীর মতামত

তালাক দেয়ার পর যদি স্ত্রী পুনরায় ওই স্বামীর সংসার করতে না চান, তবে বিয়ে বৈধ হবে না। তার ওপরে জোরপূর্বক বিয়ে চাপিয়ে দেওয়া যাবে না।

কাবিন নামার ১৮ নম্বর কলাম 

দুঃখজনক হলেও সত্য- মুসলিম আইনে স্ত্রীর তালাক দেয়ার কোনো ক্ষমতা নেই। যদি না কাবিননামার ১৮তম কলামে স্ত্রীর তালাক দেয়ার ক্ষমতা দেয়া থাকে। তাই বিয়ে রেজিস্ট্রারির আগে এ বিষয়টি অবশ্যই খেয়াল রাখবেন নারীরা।

বিয়ে প্রত্যাখ্যান

১৮ বছর বয়স হওয়ার আগেই যদি অভিভাবকের মাধ্যমে বিয়ে দেয়া হয় এবং স্বামী-স্ত্রী সহবাস বা বসবাস না করেন, তা হলে ১৯ বছর বয়স হওয়ার আগেই এ বিয়ে প্রত্যাখ্যান করলে স্ত্রী তালাক দিতে পারবেন।
